1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the PatriotCompass iOS app and related website ("App," "Service," or "PatriotCompass"), operated by Nataqua Ventures LLC ("we," "us," or "our").

By downloading, accessing, or using PatriotCompass, you agree to:

• Be bound by these Terms
• Comply with our Privacy Policy
• Follow all applicable laws and regulations

2. Description of Service

PatriotCompass is an iOS app that delivers American historical and patriotic content, including:

• Daily historical events from American history
• Patriotic quotes from American leaders and historical figures
• U.S. flag status updates
• Home-screen widgets and optional daily notifications
• Additional features for members (paid subscribers)

3. Eligibility

You must be at least 13 years old to use PatriotCompass. If you are under 18, you must have permission from a parent or guardian. By using this Service, you represent that you meet these requirements.

4. Account Registration and Security

4.1 Account Creation

• You may read core content without an account
• Membership features require an account
• Accounts are created and managed through our identity provider, Clerk, using your email or a supported sign-in such as Google
• You must provide accurate and complete information

4.2 Account Security

• You are responsible for all activities under your account
• You are responsible for safeguarding the credentials you use to sign in
• Notify us immediately of any unauthorized access
• We are not liable for losses resulting from unauthorized account use

5. Subscription and Payment Terms

5.1 Free and Member Tiers

• Free Tier: Provides core features at no cost (supported by ads)
• Membership: Unlocks additional features and removes ads for a subscription fee

5.2 Purchase Methods

Membership is an auto-renewing subscription that you may purchase through either of two methods. Current prices are shown in the App Store and at web checkout before you confirm.

• Apple In-App Purchase: Billed through your Apple ID. Your subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it in your App Store account settings. These purchases are also subject to Apple’s applicable terms.
• Web Checkout (Stripe): Billed through Stripe when you purchase on our website. Your subscription automatically renews until cancelled. You can manage or cancel it through the billing portal or by contacting support.

5.3 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused time in the billing period
• You retain access to member features until the end of the paid period

5.4 Refunds

• Subscriptions purchased through Apple are subject to Apple’s refund policies; refund requests for those purchases are handled by Apple
• For purchases made through web checkout, contact us at billing@patriotcompass.us and we will review refund requests in good faith

5.5 Price Changes

• We reserve the right to change subscription prices
• Price changes will not affect your current billing period
• We will provide notice before any price increase as required by the applicable platform
• Continued use after a price change takes effect constitutes acceptance

5.6 Personal Use; No Account Sharing

A membership is a personal, non-transferable license for use by one individual. You may use your membership across the devices you personally own or control. You may not share, sell, lend, or otherwise distribute your account credentials, or provide membership access to other people, in order to give multiple individuals the benefit of a single subscription.

To protect against subscription abuse, and to the extent permitted by applicable law and the rules of the platform through which you subscribed, we reserve the right to detect and respond to credential sharing that goes beyond an individual's personal use. Our response may be graduated and may include limiting the number of devices that can access a membership at one time, requiring re-verification of your account, suspending membership benefits, or suspending or terminating the account under Section 12.2. This provision is not intended to restrict a single member's use of the Service on their own devices.

6. User Conduct and Responsibilities

6.1 Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse engineer, decompile, or disassemble the app
• Use automated systems to access the Service
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Share your member account credentials with others
• Use the Service for any commercial purpose without permission

6.2 Content Standards

PatriotCompass provides educational and patriotic content. While we strive for historical accuracy, content is provided "as is" without warranty of completeness or accuracy.

7. Intellectual Property Rights

7.1 Our Rights

• PatriotCompass and all related content are owned by us or our licensors
• The app, including its code, design, and content, is protected by copyright, trademark, and other laws
• You may not copy, modify, distribute, or create derivative works

7.2 Third-Party Content

• Some images are sourced from NASA, the National Park Service, and other providers
• Third-party content is subject to the respective provider's licenses
• We provide proper attribution where required

7.3 Limited License

We grant you a personal, non-exclusive, non-transferable, revocable license to use PatriotCompass for your personal, non-commercial use, subject to these Terms.

8. Apple App Store Terms

These Terms are between you and Nataqua Ventures LLC only, not with Apple Inc. ("Apple"). You acknowledge that:

• Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for the app
• Apple provides no warranty for the app; any warranty claims are our responsibility, to the extent a warranty is not effectively disclaimed
• Apple is not responsible for addressing any claims relating to the app, including product-liability, regulatory, or intellectual-property claims
• You will comply with applicable App Store Terms of Service and Usage Rules when using the app
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

9. Privacy and Data

Your use of PatriotCompass is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Content will be accurate, complete, or current
• Defects will be corrected
• The Service will meet your expectations

10.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months before the claim
• For free users, our liability is limited to $10 USD
• We are not liable for losses resulting from your use or inability to use the Service

10.3 Historical Content Disclaimer

Historical content is provided for educational purposes. While we strive for accuracy, we do not guarantee the completeness or accuracy of historical information. Users should verify important historical facts from authoritative sources.

11. Indemnification

You agree to indemnify, defend, and hold harmless PatriotCompass, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the Service

12. Termination

12.1 Termination by You

• You may stop using PatriotCompass at any time by deleting the app from your device
• You may permanently delete your account at any time using the “Delete account” option in the app, or by contacting support

12.2 Termination by Us

We reserve the right to suspend or terminate your access to PatriotCompass at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Sharing or abuse of subscription access in violation of Section 5.6
• Non-payment of subscription fees
• Any reason at our sole discretion

12.3 Effect of Termination

• Upon termination, your right to use the Service ceases immediately
• Termination does not affect any obligations incurred before termination
• Sections that by nature should survive termination will remain in effect

13. Modifications to Service and Terms

13.1 Service Modifications

• We may modify, suspend, or discontinue the Service at any time
• We may add or remove features without notice
• We are not liable for any modifications or interruptions

12.2 Terms Modifications

• We may revise these Terms at any time
• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the Service

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a claim, you agree to contact us at support@patriotcompass.us to attempt informal resolution. We'll work in good faith to resolve disputes.

13.3 Arbitration Agreement

If informal resolution fails, disputes will be resolved through binding arbitration rather than court litigation, except you may assert claims in small claims court.

• Arbitration is conducted by the American Arbitration Association (AAA)
• Each party pays their own costs
• No class actions: disputes must be brought individually

13.4 Class Action Waiver

You agree to bring claims against us only in your individual capacity, not as a class member or representative in any class or representative proceeding.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PatriotCompass.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.

14.5 Third-Party Beneficiaries

Except for Apple and its subsidiaries as described in Section 8, these Terms do not create any third-party beneficiary rights.

14.6 Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control (natural disasters, war, government actions, internet outages, etc.).

15. Copyright and DMCA

15.1 Copyright Policy

We respect intellectual property rights. If you believe content in PatriotCompass infringes your copyright, please contact us with:

• Description of the copyrighted work
• Location of the allegedly infringing content
• Your contact information
• Statement of good faith belief that use is unauthorized
• Statement under penalty of perjury that the information is accurate
• Physical or electronic signature of the copyright owner
